One, brought by Alabama resident Charles E. Winborn and Alabama-based company W.T.W. Enterprises, says plaintiffs “relied on contractual agreements” to make fuel purchases from Pilot rather than its competitors. It filed suit in the Northern District of Alabama and asks for a jury trial.
The second is being brought by National Trucking Financial Reclamation Services and alleges, like the others Pilot Flying J withheld millions of dollars from carriers, relying heavily on the FBI affidavit released April 18 as evidence to its claims. NTFR is suing for fraud, deceptive trade practices (violating state statutes), unjust enrichment, financial conversion, beach of contract and fraudulent concealment. It is seeking compensatory damages, punitive damages, barring of continuation of conduct and costs incurred in seeking settlement. It’s also seeking a jury trial for the litigation.
