Appeals court rules against Contract Transport in driver’s FMLA case

A driver for Des Moines, Iowa-based Contract Transport is an eligible employee under the Family and Medical Leave Act because Contract took over a U.S. Postal Service contract from the driver’s previous employer and essentially did not change his working conditions, the U.S. Court of Appeals for the Sixth Circuit has ruled.

The appeals court overturned a district court ruling that a merger or transfer of assets is a precondition to successor liability under the FMLA. For more information, search Case No. 05-6196 at www.ca6.uscourts.gov.
