Court: Vitran not required to return to work manager who took FMLA leave

Vitran Express was not required to return to work a service center manager who – while on Family Medical Leave Act leave – the company found had not been performing competently, the U.S. Court of Appeals for the Seventh Circuit ruled recently.

Other employees filling the manager’s duties discovered that the terminal was disorganized, employees were not following procedures, freight was sitting on the dock and damaged freight was hidden in trailers, among other problems.
