U.S. Treasury reinstates business-owner reporting requirement

Finance-crimes network’s business information reporting requirement back in effect

After nearly a year of back and forth amid legal challenges, a U.S. District Court in Texas has lifted an injunction that will now allow the U.S. Department of Treasury’s Financial Crimes Enforcement Network (FinCEN) to enforce the Corporate Transparency Act.

In doing so, “beneficial ownership information (BOI) reporting requirements under the Corporate Transparency Act (CTA) are once again back in effect,” FinCEN said in a notice published Feb. 18.

On Jan. 7, 2025, the U.S. District Court for the Eastern District of Texas issued an order staying FinCEN’s regulations implementing the BOI reporting requirements, precluding FinCEN from requiring BOI reporting or otherwise enforcing the CTA’s requirements.

On Feb. 5, the U.S. Department of Justice -- on behalf of Treasury -- filed a notice of appeal of the district court’s order and, in parallel, requested a stay of the order during the appeal.

On Feb. 18, the court agreed to stay its Jan. 7 order until the appeal is completed. As a result, subject to any applicable court orders, BOI reporting is now mandatory.

As previously reported, under the CTA, all existing LLCs and other small businesses required to register with their secretaries of state are required to report their BOI to FinCEN, identifying owners and more.

The requirement has been mired in legal challenges since it was put into effect early last year. With the lifting of the injunction this week, FinCEN is now requiring businesses to report their BOI by March 21. The Treasury noted, however, that in keeping with its “commitment to reducing regulatory burden on businesses, during this 30-day period FinCEN will assess its options to further modify deadlines, while prioritizing reporting for those entities that pose the most significant national security risks.”

FinCEN said it will provide an update before the March 21 deadline of any changes to the deadline.

The anniversary celebration will honor the rich history of the Mobil Delvac brand. Established in 1925, DELVAC stands for "Diesel Engine Lubricant by Vacuum Oil Company." Initially created to support the emerging diesel industry, the brand demonstrated remarkable resilience against global challenges, eventually becoming the gold standard across multiple industries, the company said.

Throughout the century, Mobil Delvac teams have made diesel technology indispensable worldwide. They enhanced cargo truck reliability for efficient material flow, improved machine resilience in harsh climates, and developed lubricant analysis programs for better operational planning.

PGT Trucking president appointed to ATRI Board

The American Transportation Research Institute (ATRI) has announced the appointment of Gregg Troian, President of PGT Trucking (CCJ Top 250, No. 78) to its Board of Directors. Troian was appointed by ATRI Chairman of the Board Derek Leathers, Werner Enterprises (No. 14) Chairman and CEO.

Troian has more than 40 years of transportation experience, 38 of which have been spent at PGT. Throughout his career, he has held multiple roles in Operations, Business Development and Senior Leadership, including President and CEO of a large 3PL company. 

Troian is a current member of the PGT Board of Directors and has played a major role in the growth and development of PGT. He continues to lead the company through the Future of Flatbed initiative, revolutionizing transportation with the use of innovative technology and zero-emissions equipment. 

Troian was a member of the 2023-2024 ATRI Research Advisory Committee and also serves as Vice Chairman on Pennsylvania Governor’s Motor Carrier Safety Advisory Committee through the Pennsylvania Chamber of Commerce and the Ryder Carrier Advisory Board. 

In addition to his service with ATRI, Gregg is a member of the American Trucking Associations (ATA), American Iron & Steel Institute (AISI), Association for Iron & Steel Technology (AIST), Metals Service Center Institute (MSCI), Pennsylvania Motor Truck Association (PMTA), Truckload Carriers Association (TCA), and Truckers Integral to Our Economy (TIE).
