Court: Fleets can’t sue toll commissions

Trucking companies do not have a right to sue toll commissions in federal courts in order to enforce the statutory requirement that bridge tolls be “just and reasonable,” the U.S. Court of Appeals for the Third Circuit ruled.

In deciding the challenge of the American Trucking Associations and other trucking parties to tolls set by the Delaware River Joint Toll Bridge Commission, the court suggested that truck owners seek a private right of action from Congress.
