Appeals court upholds decision for Watkins in obesity suit

Morbid obesity unrelated to a physiological cause is not an impairment under the Americans with Disabilities Act, the U.S. Court of Appeals for the Sixth Circuit ruled, upholding a lower court decision in favor of Watkins Motor Lines.

In rejecting an appeal by the Equal Employment Opportunity Commission, the court also ruled that Watkins did not perceive the driver/dock worker in question “as substantially limited in any major life activities.” (Case No. 05-3218)
