Lower court ordered to decide UPS disability case

The U.S. Court of Appeals for the Ninth Circuit has ordered a lower court to determine whether a UPS driver’s asserted problems with breathing and functioning in temperatures of 90 degrees or higher constituted a disability that had to be reasonably accommodated under the Americans with Disabilities Act by provision of an air-conditioned tractor.

The ruling overturned the summary judgment granted to UPS by the district court.
