Smoky car swerves for Irish pub. Was this accident preventable?

Truck driver John Doe was making his way eastbound on Cola Pop Parkway in Soda Springs, Idaho, on a sunny afternoon. The drive seemed ordinary until he noticed a haze of blue smoke drifting across the roadway.
 
The smoke came from a slow-moving, oil-burning car in the left lane. As Doe held steady in the center lane to avoid the cloud, the car’s driver suddenly cut over without signaling, intent on making a stop at a nearby Irish pub.
 
The lane change ended with the car colliding into Doe’s truck, leaving minor damage to the wheel well. Doe’s safety director ruled it preventable, arguing that Doe should have anticipated trouble from the smoky car.
