Lawsuit alleging LTL antitrust violations dismissed

The U.S. District Court for Northern Georgia recently dismissed a lawsuit filed by shippers asserting antitrust violations by a number of less-than-truckload carriers in connection with fuel surcharges.

Shippers contended that the LTL carriers exchanged information in various ways regarding fuel surcharge levels and had agreed to various methodologies.

But the district court ruled in late January that the shippers had to allege more than “parallel conduct” and rather had to make the case that the actions resulted from an illegal conspiracy.
