Drug and alcohol clearinghouse rule becoming reality: Agency announces proposed rule set for publication
A proposed rule establishing a Commercial Driver’s License Drug and Alcohol Clearinghouse was announced Feb. 12 by FMCS. The rule will establish a database of CDL holders that have failed or refused a drug test and require carriers to upload such information and query the database when hiring drivers.

The two-truck, five-driver carrier received a conditional rating during a Dec. 20 compliance review. The carrier was given until Jan. 19 to correct issues to avoid revocation, but failed to present proof of correction to the FMCSA by that time.

$3.5 million accident lawsuit against FFE dismissed
FFE Transportation (N0. 62 in the CCJ Top 250) won a lawsuit filed against it by the City of Saint Jo after a jury in a Texas district court ruled Jan. 14 in favor of the fleet by rejecting the city’s $3.5 million suit filed over a crash that took place in 2010.

The national average price for a gallon of on-highway diesel jumped again in the week ended Feb. 10, rising 2.6 cents to $3.977. The price of diesel has now risen 10.4 cents in the last three weeks and has hit its highest point since the week ended Sept. 9’s $3.981.
