Changes requested to proposed ‘hot fuel’ settlement

The judge presiding over the multi-district “hot fuel” suit has asked the case’s defendants — oil refiners and retailers — to adjust their proposals nearly a month after jurors returned a verdict in favor of the three retailers in the case, QuikTrip, 7-Eleven and Kum & Go. Plaintiffs sued arguing that warmer fuel has less energy and is therefore worth less than cooler fuel, adding that retailers did not disclose this information nor adjust prices to make up for it.

Other retailers reached a settlement in a separate case this summer — BP, Citco, Exxon Mobil, Motiva Enterprises, Equilon Enterprises and Sinclair Oil all have settlements that are awaiting court approval.
