FAA bill renews fight over states’ ability to require breaks for truckers, reform driver pay
A measure in a House bill would block states from enforcing mandatory paid meal and rest breaks for truckers and their carrier employers and prevent states from undertaking driver pay reform measures. ATA announced its support for the measure Thursday, while a prominent Senator vowed to fight the provision.

The 2016 fiscal year appropriations bill passed by Congress in December and signed into law by President Obama the same month may have included a major unintentional consequence: Removing the 34-hour restart rules from the federal code entirely, rather than simply suspending enforcement of certain 34-hour restart provisions.

House committee clears bill that exempts carriers from complying with state laws on driver pay, breaks
The trucking-relevant clauses would: (1) Block states from requiring drivers to take meal and rest breaks, if such a law is on the books at the state level, (2) exempt carriers from penalties for not requiring drivers to take state-law-required breaks and (3) Allow carriers, as employers, to skirt any state laws requiring drivers be paid “separate or additional compensation” beyond mileage or other base pay.

A new federal rule that implements large fines for carriers, shippers and brokers caught pressuring drivers to operate beyond federal safety regulations, such as when they’re out of hours, is now in effect, as is a new system for truckers to file complaints for alleged coercion instances with the Federal Motor Carrier Safety Administration.

The request would exempt Farruggio’s drivers who stay within the 100 air-mile radius but occasionally exceed the 12-hour limitation from having to complete a daily record of duty status. The company says approximately 12 percent of its drivers exceed the 12-hour limitation on a weekly basis, primarily due to waiting times at rail yards and piers.
