Bill clears house that would exempt propane haulers of HOS until May 31
The U.S. House cleared a bill March 4 that would if passed give propane haulers and other home heating fuel transporters in 36 states an exemption to federal hours-of-service regulations.

Hours of service waivers issued for some haulers of fuel, salt, other relief loads
In light of severe cold temperatures impacting much of the country and some nationwide fuel distribution problems, FMCSA and some states have continued issuance of hours-of-service waivers for fuel haulers and, now, some other relief loads, like road salt, food and livestock.

Based on jurisdictional grounds, a U.S. Court of Appeals in D.C. has transferred a case brought against the Federal Motor Carrier Safety Administration and its inability to remove violations from a carrier or driver’s safety record if the violation is dismissed in court or the carrier is found not guilty.

Congress is considering a bill to extend current hours-of-service waivers for propane and other home heating truckers until May 31. On Feb. 25, Rep. Bill Shuster (R-Pa.) introduced the Home Heating Emergency Assistance Through Transportation Act or H.R. 4076, which has nine co-sponsors.

An FMCSA committee wants to see a law that would require motor carriers to compensate drivers for time spent working (on duty) but not driving as well as provide minimum pay guarantees. Drivers will have to embrace electronic logs and other in-cab technology to have a chance.

FMCSA announced Feb. 13 it has shut down a driver who the agency discovered had violated hours of service limits and falsified his logs prior to hitting two stationary vehicles, killing one person and seriously injuring another.
